Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of dashboard.chillcountry.com (the "Dashboard"), an internal operational platform operated by THC Provisions LLC, doing business as Chill Country ("Chill Country," "we," "us," or "our"). By accessing or using the Dashboard, you agree to these Terms.

Who can use the Dashboard

Most of the Dashboard is restricted to current employees and authorized contractors of Chill Country who sign in with a Chill Country-issued Google Workspace account. If you don't fit that description, you should not attempt to sign in.

A limited portion of the Dashboard — most notably the Certificate of Analysis (COA) lookup that customers reach from Chill Country product packaging — is open to the public.

Acceptable use

When using the Dashboard, you agree not to:

• Access or attempt to access information you are not authorized to see.
• Interfere with the operation of the Dashboard, attack it, probe it, or circumvent any security or access control.
• Use the Dashboard to violate any law or any contractual obligation Chill Country owes to a third party.
• Misuse data exported from the Dashboard, including operational data, customer data, or third-party data we pull on Chill Country's behalf.
• Use the Dashboard to send spam, malware, or other harmful content.
• Reverse engineer the Dashboard except to the extent permitted by applicable law.

Your account

If you sign in to the Dashboard, you are responsible for activity that takes place under your account. Notify Chill Country promptly if you believe your account has been used without your authorization. Chill Country may suspend or terminate access to the Dashboard at any time, with or without notice, for any reason — including if you no longer work with Chill Country or if we believe you have violated these Terms.

Intellectual property

The Dashboard, including its software, design, text, graphics, and underlying data, is owned by Chill Country or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any ownership interest in the Dashboard. You may use the Dashboard only as permitted by these Terms and only in connection with your authorized work for Chill Country.

Third-party services

The Dashboard integrates with third-party services such as Google, Meta, Shopify, Klaviyo, and others. Your use of those services through the Dashboard is also governed by their own terms and policies. Chill Country is not responsible for the availability, content, or practices of those services.

Changes to the Dashboard

We may add, modify, or remove features of the Dashboard at any time, and we may update these Terms from time to time. When we update these Terms we will revise the "Effective date" at the top of this page. Continued use of the Dashboard after changes take effect constitutes acceptance of the updated Terms.

Disclaimers

THE DASHBOARD IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHILL COUNTRY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE DASHBOARD WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Operational data displayed on the Dashboard is provided for internal informational purposes only and may be incomplete, delayed, or inaccurate. It should not be relied on as the sole source of truth for material business decisions without independent verification.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CHILL COUNTRY AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE DASHBOARD. CHILL COUNTRY'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE DASHBOARD WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or the Dashboard will be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.

Termination

We may terminate or suspend your access to the Dashboard at any time, for any reason, with or without notice. Upon termination, your right to use the Dashboard will immediately cease. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
